Hvis Al Bashir kommer forbi: - skal Danmark udlevere Sudans præsident til Den Internationale Straffedomstol?

For the first time in its history, the International Criminal Court ("ICC") issued an arrest warrant for a sitting Head of State in March 2009. The purpose of the article is to determine whether Denmark - if the possibility of arrest were to arise - can and must extradite the president of Sudan, Omar Al Bashir, to the ICC. To that end, the article discusses a number of pertinent issues regarding inter alia the immunity of state representatives, the interpretation of Articles 27 and 98 of the Statute of the International Criminal Court and conflicts between Security Council resolutions and other norms of international law.
