The rise of the sharing economy has enabled a host of new opportunities for private individuals to sell their labor in a flexible way via online platforms. Initially, these platforms were meant to offer individuals the possibility to earn a little extra money on the weekends and spare time, e.g. by driving others in one’s car. As these platforms have matured, and a growing share of the service providers (“gig workers”) depend on them for their main income, the matter of their right to unionize and engage in collective bargaining has emerged. However, competition law might not allow this and the papers seek to explore ways to accommodate this within established case law. Further, comparisons to the legal position in USA are made.
