Recent international decisions have triggered much discussion on the contested role of investment protection for intellectual property (IP) related to public health matters as a tool for rightsholders to ensure their IP assets are protected abroad. This adds another dimension to the longstanding controversial discourse related to the balance between providing incentive mechanisms as a motivator of innovation and limiting protection in favour of public interest.
This seminar features a distinguished list of speakers who will outline the legal developments leading up to the most recent decisions related to investment protection in the pharmaceutical industry and debate some of the legal challenges arising from these issues. This seminar will also explore how various international instruments such as TRIPS and the Doha Declaration may provide flexibilities in regards to balancing IP rights and public health policy.
