The regulation covering technology licensing agreements that may affect trade between EU Member State and therefore be subject to Article 101 TFEU has some important changes to its 2004 predecessor and parties have until 30 April 2015 to ensure that existing agreements are put in conformity with the new rules. It is therefore important to consider and identify the substantive changes between the 2004 regulation and the new framework by comparing the two. Furthermore, the regulation makes substantive changes to the scrutiny of settlement agreements, what, if anything, does this mean for agreements that have non-attack/invalidity requirements? There will be opportunity for discussion after the presentation.
